These Terms and Conditions (“Terms”) govern your use of the FotoCrats website, platform, services, and applications (collectively, “Platform”) operated by Sepia Advertising Pvt. Ltd. (“we,” “our,” “us”). By accessing or using our Platform, you agree to be bound by these Terms.

1. Scope of Services

FotoCrats is a niche job platform designed to connect creative professionals with clients, companies, and collaborators in need of services in domains including but not limited to photography, videography, editing, graphic design, animation, writing, and other visual, media, and design fields.

2. Eligibility

   You may use the FotoCrats platform only if you:

   • Are at least 18 years of age
   • Have the legal capacity to enter into a binding agreement under applicable law;
   • Are either a creative professional or an authorized representative of a company or client seeking to hire such professionals.
3. User Accounts
   • Users must register and create an account by providing accurate, complete, and updated information.
   • You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
   • You agree not to share your login credentials with any third party or impersonate another person or entity.
4. Portfolios, Resumes, and Profile Submissions
   • Users may upload personal portfolios, resumes, sample projects, profile videos, and other relevant content to enhance discoverability.
   • By uploading such content, you grant FotoCrats a non-exclusive, royalty-free, worldwide license to use, display, store, reformat, and share the content solely for the purpose of enabling Platform functionality.
   • FotoCrats may make technical modifications to the content for optimization or promotional use within the platform.
5. Job Listings and Applications
   • FotoCrats does not guarantee job interviews, offers, or hiring outcomes.
   • All job postings are the sole responsibility of the posting entity. FotoCrats is not liable for any inaccuracies, misrepresentations, or false information in listings.
   • FotoCrats reserves the right to edit, suspend, or remove job listings or applications that violate these Terms or any applicable law.
6. Data Privacy
   • FotoCrats collects, stores, and uses personal information as outlined in its Privacy Policy.
   • Data such as browsing behavior, job preferences, tags, and uploads may be processed for the purpose of matchmaking and platform enhancement.
   • Employers are responsible for handling candidate data in compliance with applicable data protection laws.
7. Payments and Premium Services
   • FotoCrats offers a freemium model. Free accounts are available to all users.
   • Premium features including priority listings, extended portfolio space, or advanced job alerts may require a paid subscription.
   • All payments are due in advance and are non-refundable unless otherwise stated in a specific agreement or promotional offer.
8. Prohibited Activities

   Users agree not to:

   • Post misleading, fraudulent, defamatory, obscene, or illegal content;
   • Use the platform to solicit or distribute spam or unrelated commercial content;
   • Harass, threaten, or abuse other users;
   • Upload copyrighted content without proper authorization;
   • Reverse engineer, duplicate, or exploit any part of the Platform’s source code or backend systems.
9. Communication and Notifications
   • By registering with FotoCrats, you consent to receive email or in-platform notifications related to account activity, job matches, marketing updates, or platform enhancements.
   • You may opt out of non-essential promotional communications via your account settings at any time.
10. Termination of Access
    • FotoCrats reserves the right to suspend, restrict, or terminate any account that breaches these Terms or harms the integrity and operation of the Platform.
    • Users may voluntarily delete their accounts through the platform dashboard. Upon termination, FotoCrats may retain essential information as required under applicable law.
11. Limitation of Liability
    • FotoCrats acts as an intermediary platform and is not a party to any contract, project, or employment relationship between users.
    • We shall not be liable for any loss of data, profit, opportunity, or damages arising from your use of the Platform.
    • FotoCrats does not endorse or guarantee the authenticity or quality of work, nor the reliability of any user.
12. Platform Modifications

    FotoCrats reserves the right to:

    • Modify or discontinue the Platform (in whole or part) at any time;
    • Introduce new services or adjust existing features
    • Change the pricing structure for premium plans with reasonable prior notice.
13. Governing Law and Dispute Resolution
    • These Terms shall be governed by and construed in accordance with the laws of India.
    • Any dispute or claim shall be subject to binding arbitration under the Indian Arbitration and Conciliation Act, 1996, conducted in Noida, India.
    • The arbitration proceedings shall be conducted in English/Hindi.
